Please read before field use

Terms of Use

These Terms govern your use of Dipper Field. The app supports field observations and data management; it does not replace professional surveying, engineering judgment, safety procedures, or an authoritative system of record.

Effective October 26, 2026 · Version 1.4

1. Agreement

These Terms of Use (“Terms”) are a legal agreement between you and Insight Spatial L.L.C., a North Carolina limited liability company (“Insight Spatial,” “we,” “us,” or “our”), governing the Dipper Field mobile application, related documentation, the template library, and the Dipper Field website (collectively, the “Service”). By downloading, accessing, or using Dipper Field, you agree to these Terms and our Privacy Policy. If you use the Service for an employer or other organization, you represent that you have authority to accept these Terms for that organization, and “you” includes that organization. You must be old enough to enter into a binding contract where you live, or use Dipper Field with the consent and supervision of a parent or guardian.

Dipper Field is provided free of charge, and you use it at your own risk. By using it, you accept responsibility for how and where you use it, for the data you collect and share with it, for checking its results, and for the decisions you make based on them. Insight Spatial is responsible only to the limited extent described in sections 12 and 13 and required by law.

If you do not agree, do not use Dipper Field. If you live in the United States, section 17 requires disputes to be resolved by individual arbitration rather than in court or by class action, unless you opt out. Mandatory consumer protections in your jurisdiction remain unaffected; see section 14.

2. License and ownership

Subject to these Terms and the applicable app-store rules, we grant you a limited, personal or internal-business, non-exclusive, non-transferable, revocable license to install and use Dipper Field on devices you own or control. You may not rent, sublicense, sell, reverse engineer except where law permits, bypass technical safeguards, or use the Service to create an unlawful or infringing product.

Dipper Field, its interface, software, branding, documentation, and built-in and published templates are owned by Insight Spatial or its licensors. Open-source components and third-party content remain subject to their own licenses and notices. If you send us ideas or suggestions, we may use them without any obligation to you.

3. Your projects and content

You retain ownership of project records, geometry, forms, photos, videos, voice notes, reports, templates you create, imported files, and other content you create or bring into Dipper Field (“Your Content”). You grant us no right to use Your Content merely because it is stored in the app; we do not receive it unless you send it to us. When you direct Dipper Field to send content to a third-party service, you authorize the processing needed to complete that action.

You are responsible for Your Content and represent that you have the rights, permissions, notices, and lawful basis needed to collect, record, scan, photograph, film, import, process, and share it. This includes respecting privacy, workplace rules, property rights, confidentiality, records laws, and any restrictions on recording people, infrastructure, or restricted locations. If you record the location or activities of other people, such as staff or contractors, you are responsible for any notice and consent that employment, privacy, or monitoring laws require.

4. Field work, safety, and professional limitations

Dipper Field is a data-collection and visualization aid. Coordinates, GPS tracks, map imagery, labels, elevations, directions, weather, calculated lengths and areas, topology checks, and generated reports may be delayed, incomplete, generalized, or inaccurate.

  • Dipper Field is not a licensed survey instrument and does not establish a legal boundary, easement, title, or certified location.
  • It is not engineering, architectural, environmental, legal, or safety advice, and it does not certify an inspection, asset condition, or compliance with any requirement.
  • It is not an emergency or navigation service. Do not rely on it for dispatch, life safety, excavation clearance, utility location, confined-space entry, traffic control, or hazard avoidance.
  • Do not look at or operate Dipper Field while driving or operating machinery.
  • Always follow site procedures, laws, permits, utility-location requirements, and instructions from qualified professionals, and obtain permission before entering private or restricted land.

Field work can involve hazards such as traffic, water, heights, terrain, weather, wildlife, utilities, and machinery. You decide where, when, and how you work. To the extent permitted by law, you assume the risks of your field activities, and you must independently verify information before making decisions that could affect safety, property, compliance, construction, maintenance, or significant cost.

5. Templates and the template library

Built-in templates, and templates Dipper Field downloads from our template library, are general starting points. They are not official, regulatory, or employer-approved forms, and using one does not mean that an inspection, survey, or record meets any law, standard, permit, or contract. Review and adapt a template before relying on it.

We may add, change, or withdraw templates at any time, including by updating them online without an app update. Projects you have already created from a template are not changed. Templates you create, import, or share with others are Your Content.

6. Local storage, backups, and data loss

Dipper Field is local-first. Unless you export or transfer it, the working project database is stored on your device, and we do not keep a copy. You are responsible for maintaining appropriate exports and backups, confirming that a transfer completed correctly, and testing restoration procedures required by your organization.

Deleting a project, clearing app data, uninstalling the app, losing a device, storage failure, operating-system cleanup, or an interrupted import can cause permanent data loss. Recoverable drafts are a convenience, not a guaranteed backup. Do not use a single device copy as the only authoritative record.

7. Maps, weather, search, and third-party content

Dipper Field can display or request content from Google Maps Platform, Apple services, Open-Meteo, device geocoders, and map sources you configure. Their availability, coverage, accuracy, currency, attribution, licensing, quotas, and terms are controlled by those providers. Saved offline maps show the map as it was when saved and can become out of date. We do not own third-party map imagery or guarantee that a source will remain available.

Use of Google map content is subject to the Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy. You must preserve all provider attribution displayed by Dipper Field and may not scrape, bulk download, obscure attribution, or redistribute restricted map content.

You are responsible for confirming that any custom XYZ, WMS, WMTS, ArcGIS, or other map source, and any map file you import, permits your intended access, caching, offline use, display, export, and commercial use. You are also responsible for protecting API keys and paying provider charges associated with sources you configure.

8. Cloud storage and external destinations

Optional connections to Google Drive, Microsoft OneDrive, Dropbox, S3-compatible storage, system file providers, and sharing destinations are third-party services. Your use is governed by the provider’s agreement and organization policies. We do not control provider uptime, authentication, quotas, file versioning, malware scanning, retention, or account suspension.

You are responsible for choosing the correct account, folder, project, coordinate reference system, import mapping, and conflict outcome; checking imported and exported results; and ensuring that a transfer is permitted. Dipper Field does not promise continuous synchronization or that an external dataset is safe, complete, or compatible.

9. Receivers, correction services, and coordinate data

External GNSS receivers, RTK correction services, and other hardware or services you connect are made and run by others and are covered by their own terms. You are responsible for your correction-service subscriptions and credentials and for any charges they incur.

Position quality, fix status, and accuracy figures shown in Dipper Field come from the receiver or the device and are estimates. They can be wrong because of satellite geometry, obstructions, multipath, interference, correction-service outages, antenna-height or setup errors, or receiver firmware. Coordinate conversions, datum grids, geoid models, and height systems rely on public data published by national agencies and the PROJ project, which may change or contain errors, and results may differ from those of other software or an official survey. Where accuracy matters, check results against known control points.

10. Acceptable use

You may not use Dipper Field to:

  • violate law, privacy, intellectual-property, export-control, sanctions, or contractual obligations;
  • trespass, conduct unauthorized surveillance or tracking of people, facilitate harm, or collect restricted critical-infrastructure data without authority;
  • upload malicious code, attack a service, evade access controls, overload our website or template library, or interfere with other users or providers;
  • misrepresent approximate information as certified, manipulate records fraudulently, or remove required attribution; or
  • use third-party content beyond the license granted by its provider.

11. Availability, support, and changes

Dipper Field is currently provided free of charge. If we offer paid features in the future, we will show you their price and terms before you buy. We provide support at our discretion and do not promise response times, the availability of our website or template library, or that any feature will continue.

We may add, modify, suspend, or discontinue features and may release updates needed for security, compatibility, law, or provider requirements. Device compatibility and outside services can change. We do not guarantee that every feature or template is available in every country, language, device, or app version.

We may update these Terms by publishing a revised version at this stable URL and changing the effective date. If a change is material, we will give notice in the app or release notes before it takes effect. If you do not agree to a change, you may stop using Dipper Field. Continued use after the new effective date constitutes acceptance to the extent permitted by law.

12. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIPPER FIELD, THE TEMPLATE LIBRARY, AND ALL INCLUDED OR THIRD-PARTY CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND YOU USE THEM AT YOUR OWN RISK. INSIGHT SPATIAL DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND DATA PRESERVATION. WE DO NOT WARRANT THAT THE SERVICE OR ANY POSITION, MEASUREMENT, MAP, TEMPLATE, OR REPORT WILL BE ACCURATE, COMPLETE, ERROR-FREE, SECURE, UNINTERRUPTED, OR SUITABLE FOR A PARTICULAR FIELD PROCEDURE OR LEGAL REQUIREMENT.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSIGHT SPATIAL AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND DISTRIBUTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, BUSINESS, GOODWILL, OR USE, OR FOR THE COST OF REPEATING FIELD WORK, ARISING FROM DIPPER FIELD, THIRD-PARTY SERVICES OR HARDWARE, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID INSIGHT SPATIAL FOR DIPPER FIELD DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $50. IF YOU ARE DISSATISFIED WITH THE SERVICE, YOUR SOLE REMEDY IS TO STOP USING IT. Because Dipper Field is provided free of charge, to the extent permitted by law we are liable only for damage caused by our intentional misconduct or gross negligence. To the extent permitted by law, a claim must be brought within one year after it arises. Some jurisdictions do not allow certain exclusions or limits, so these provisions apply only to the extent permitted.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for intentional misconduct or gross negligence, or under product liability law, or any other liability that cannot be excluded or limited by law.

14. Your rights as a consumer

If you use Dipper Field as a consumer, you keep the rights that the law where you live gives you and that a contract cannot take away. Nothing in these Terms limits them, and sections 4, 12, 13, and 15 apply only as far as that law allows. In particular:

  • European Union, United Kingdom, and Switzerland. You also benefit from the mandatory provisions of the law of the country where you live and may bring a claim in its courts. The assumption of risk in section 4 and the indemnity in section 15 do not apply to you as a consumer.
  • Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies those guarantees or any right or remedy you have under that law. Where the law allows us to limit our liability for failing to meet a guarantee, for services not of a kind ordinarily acquired for personal, domestic, or household use, our liability is limited to supplying the services again or paying the cost of having them supplied again.
  • New Zealand. If you acquire Dipper Field as a consumer, the Consumer Guarantees Act 1993 applies, and nothing in these Terms limits your rights under it.
  • Japan. If you are a consumer under the Consumer Contract Act, sections 12 and 13 do not exclude or limit our liability for damage caused by our intentional misconduct or gross negligence, and the other limits apply only as far as that Act permits.
  • Canada and Québec. Provisions that consumer protection law in your province prohibits do not apply to you. If you live in Québec, this includes any exclusion or limit of our liability for our own acts, and the French version of these Terms is the version provided to you first.

15. Indemnity

To the extent permitted by law, you will defend and indemnify Insight Spatial and its members, employees, and contractors against third-party claims, damages, and reasonable costs, including legal fees, arising from Your Content, your field activities, the data sources, hardware, and services you connect, or your breach of these Terms or the law. This does not apply to the extent a claim results from our own breach of these Terms or unlawful conduct.

16. Suspension and termination

You may end this agreement at any time by stopping use and uninstalling Dipper Field. We may suspend access to online features, such as the template library, or terminate the license, if reasonably necessary to address a material breach, security threat, legal requirement, or provider restriction. Sections 2 (ownership and feedback), 3, 4, 5, 9, and 12 through 19 survive termination.

17. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, USA, and, for this section, the U.S. Federal Arbitration Act, without regard to conflict-of-law rules. Except for disputes resolved by arbitration under this section, state and federal courts located in North Carolina will have jurisdiction, except where applicable consumer law gives you the right to bring a claim elsewhere. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you live. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Arbitration for users in the United States. If you live in the United States, you and Insight Spatial agree to resolve any dispute arising out of or relating to Dipper Field or these Terms by binding individual arbitration, except that either of us may bring an individual claim in small-claims court, and either of us may ask a court to stop the infringement or misuse of intellectual property. Before starting arbitration, the party with a claim will send the other a written description of it and both will try to resolve it informally for 30 days. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules and, where they apply, its rules for mass filings, before a single arbitrator, by video or in the county where you live. We will pay the filing, administration, and arbitrator fees those rules require a business to pay.

YOU AND INSIGHT SPATIAL EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO BRING OR TAKE PART IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR ARBITRATION. If this waiver is found unenforceable for a claim, that claim will proceed in court, not in arbitration. You may opt out of this arbitration agreement by emailing us within 30 days after you first accept these Terms, with the subject “Arbitration Opt-Out” and the email address you use with us. This arbitration agreement does not apply to residents of the European Economic Area, the United Kingdom, Switzerland, Canada, Australia, New Zealand, or Japan, or where the law of your place of residence prohibits it.

18. App-store terms

If you obtained Dipper Field through Apple’s App Store, these Terms are between you and Insight Spatial, not Apple. Apple has no obligation to provide maintenance or support, and is not responsible for claims relating to Dipper Field except as required by law. Insight Spatial, not Apple, is responsible for addressing any claims by you or a third party relating to Dipper Field, including product liability claims, claims that it fails to conform to a legal or regulatory requirement, claims under consumer protection or privacy law, and claims that it infringes a third party’s intellectual property rights. If Dipper Field fails to conform to an applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for it; Apple has no other warranty obligation for Dipper Field. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon acceptance.

If you obtained Dipper Field through Google Play, your use is also subject to the applicable Google Play terms. Apple, Google, and other distributors are not responsible for Your Content or third-party services you connect.

19. General

These Terms and the Privacy Policy are the entire agreement about the Service unless a separate written agreement with Insight Spatial applies. If one provision is unenforceable, it will be limited to the minimum extent necessary and the remainder remains effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or transfer of the Service. We are not responsible for delays or failures caused by events beyond our reasonable control. We may give notices in the app, on this website, or by email if you have written to us.

You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties. You will comply with export-control and sanctions laws that apply to your use of Dipper Field.

These Terms are available in English, French, and Chinese. Translations are provided for convenience; if versions conflict, the English version controls to the extent permitted by law, and mandatory rights in your jurisdiction are unaffected. If you live in Québec, the French version is provided to you first, and you may choose to be bound by another version.
