Terms of Service

These Terms govern your use of FieldWorks. The app supports field observations and data management; it does not replace professional surveying, engineering judgment, safety procedures, or an authoritative system of record.

1. Agreement

These Terms of Service (“Terms”) are a legal agreement between you and Insight Spatial LLC (“Insight Spatial,” “we,” “us,” or “our”) governing the FieldWorks mobile application, related documentation, and FieldWorks legal website (collectively, the “Service”). By downloading, accessing, or using FieldWorks, you agree to these Terms and our Privacy Policy. If you use the Service for an employer or other organization, you represent that you have authority to accept these Terms for that organization.

If you do not agree, do not use FieldWorks. Mandatory consumer protections in your jurisdiction remain unaffected.

2. License and ownership

Subject to these Terms and the applicable app-store rules, we grant you a limited, personal or internal-business, non-exclusive, non-transferable, revocable license to install and use FieldWorks on devices you own or control. You may not rent, sublicense, sell, reverse engineer except where law permits, bypass technical safeguards, or use the Service to create an unlawful or infringing product.

FieldWorks, its interface, software, branding, documentation, and included templates are owned by Insight Spatial or its licensors. Open-source components and third-party content remain subject to their own licenses and notices.

3. Your projects and content

You retain ownership of project records, geometry, forms, photos, videos, reports, imported files, and other content you create or bring into FieldWorks (“Your Content”). You grant us no general right to use Your Content merely because it is stored in the app. When you direct FieldWorks to send content to a third-party service, you authorize the processing needed to complete that action.

You are responsible for Your Content and represent that you have the rights, permissions, notices, and lawful basis needed to collect, record, scan, photograph, film, import, process, and share it. This includes respecting privacy, workplace rules, property rights, confidentiality, records laws, and any restrictions on recording people, infrastructure, or restricted locations.

4. Field work, safety, and professional limitations

FieldWorks is a data-collection and visualization aid. Coordinates, GPS tracks, map imagery, labels, elevations, directions, weather, calculated measurements, topology checks, and generated reports may be delayed, incomplete, generalized, or inaccurate.

  • FieldWorks is not a licensed survey instrument and does not establish a legal boundary, easement, title, or certified location.
  • It is not engineering, architectural, environmental, legal, or safety advice, and it does not certify an inspection or asset condition.
  • It is not an emergency or navigation service. Do not rely on it for dispatch, life safety, excavation clearance, confined-space entry, traffic control, or hazard avoidance.
  • Always follow site procedures, laws, permits, utility-location requirements, and instructions from qualified professionals. Stay aware of traffic, terrain, weather, equipment, and people while operating a device.

You must independently verify information before making decisions that could affect safety, property, compliance, construction, maintenance, or significant cost.

5. Local storage, backups, and data loss

FieldWorks is local-first. Unless you export or transfer it, the working project database is stored on your device. You are responsible for maintaining appropriate exports and backups, confirming that a transfer completed correctly, and testing restoration procedures required by your organization.

Deleting a project, clearing app data, uninstalling the app, losing a device, storage failure, operating-system cleanup, or an interrupted import can cause permanent data loss. Recoverable drafts are a convenience, not a guaranteed backup. Do not use a single device copy as the only authoritative record.

6. Maps, weather, search, and third-party content

FieldWorks can display or request content from Google Maps Platform, Apple services, Open-Meteo, device geocoders, and map sources you configure. Their availability, coverage, accuracy, attribution, licensing, quotas, and terms are controlled by those providers. We do not own third-party map imagery or guarantee that a source will remain available.

Use of Google map content is subject to the Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy. You must preserve all provider attribution displayed by FieldWorks and may not scrape, bulk download, obscure attribution, or redistribute restricted map content.

You are responsible for confirming that any custom XYZ, WMS, WMTS, ArcGIS, or other map source permits your intended access, caching, offline use, display, export, and commercial use. You are also responsible for protecting API keys and paying provider charges associated with sources you configure.

7. Cloud storage and external destinations

Optional connections to Google Drive, Microsoft OneDrive, Dropbox, system file providers, and sharing destinations are third-party services. Your use is governed by the provider’s agreement and organization policies. We do not control provider uptime, authentication, quotas, file versioning, malware scanning, retention, or account suspension.

You are responsible for choosing the correct account, folder, project, coordinate reference system, import mapping, and conflict outcome; checking imported and exported results; and ensuring that a transfer is permitted. FieldWorks does not promise continuous synchronization or that an external dataset is safe, complete, or compatible.

8. Acceptable use

You may not use FieldWorks to:

  • violate law, privacy, intellectual-property, export-control, sanctions, or contractual obligations;
  • trespass, conduct unauthorized surveillance, facilitate harm, or collect restricted critical-infrastructure data without authority;
  • upload malicious code, attack a service, evade access controls, or interfere with other users or providers;
  • misrepresent approximate information as certified, manipulate records fraudulently, or remove required attribution; or
  • use third-party content beyond the license granted by its provider.

9. Updates, availability, and changes

We may add, modify, suspend, or discontinue features and may release updates needed for security, compatibility, law, or provider requirements. Device compatibility and outside services can change. We do not guarantee that every feature or template is available in every country, language, device, or app version.

We may update these Terms by publishing a revised version at this stable URL and changing the effective date. If a change is material, we will provide additional notice where appropriate. Continued use after the new effective date constitutes acceptance to the extent permitted by law.

10. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDWORKS AND ALL INCLUDED OR THIRD-PARTY CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” INSIGHT SPATIAL DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND DATA PRESERVATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, OR SUITABLE FOR A PARTICULAR FIELD PROCEDURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSIGHT SPATIAL AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND DISTRIBUTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, BUSINESS, GOODWILL, OR USE, ARISING FROM FIELDWORKS OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID INSIGHT SPATIAL FOR FIELDWORKS DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $25. Some jurisdictions do not allow certain exclusions or limits, so these provisions apply only to the extent permitted. Nothing excludes liability that cannot lawfully be excluded.

12. Indemnity

To the extent permitted by law, if you use FieldWorks for business or on behalf of an organization, you will defend and indemnify Insight Spatial against third-party claims, damages, and reasonable costs arising from Your Content, your unlawful or unauthorized field activity, your configured data sources, or your material breach of these Terms. This does not apply to the extent a claim results from our own unlawful conduct.

13. Suspension and termination

You may end this agreement at any time by stopping use and uninstalling FieldWorks. We may suspend access to online or licensed features, or terminate the license, if reasonably necessary to address a material breach, security threat, legal requirement, or provider restriction. Sections that by their nature should survive—including ownership, responsibility for content, disclaimers, liability limits, and governing law—will survive.

14. Governing law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules. State and federal courts located in North Carolina will have jurisdiction, except where applicable consumer law gives you the right to bring a claim elsewhere. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15. App-store terms

If you obtained FieldWorks through Apple’s App Store, these Terms are between you and Insight Spatial, not Apple. Apple has no obligation to provide maintenance or support, and is not responsible for claims relating to FieldWorks except as required by law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon acceptance.

If you obtained FieldWorks through Google Play, your use is also subject to the applicable Google Play terms. Apple, Google, and other distributors are not responsible for Your Content or third-party services you connect.

16. General

These Terms and the Privacy Policy are the entire agreement about the Service unless a separate written agreement with Insight Spatial applies. If one provision is unenforceable, it will be limited to the minimum extent necessary and the remainder remains effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or transfer of the Service.

Translations are provided for convenience. If versions conflict, the English version controls to the extent permitted by law; mandatory rights in your jurisdiction are unaffected.
